hey, my wife has just had a ding in her car, the mark on her car will polish out, the other person says that its a company car and that shes gonna make a claim. just out of interest though, im trying to figure if the 3rd party was partly to blame.the 3rd party was parked on a tight junction within 5 feet from the blind corner of the road. would up load pics but i dont know how lol.

Are there any yellow lines, white lines at the kerb or solid white lines in the centre of the road. Parking under any of these will be an offence and *might* put liability with the other car. What exactly happened confused

I always though there was a limit of 15 feet, or yards, from the corner. Parked any closer than that you are in breach of something.

Sorry - feeling a bit vague, but parking like that is not acceptable.

She hit a parked car? How can it ever be the other persons fault crazy If it is parked badly then report it, but hitting it is still the fault of the person in the moving vehicle surely?

Not if it's parked un-safely or in a dangerous position.

If the car was parked correctly or a safe distance from the junction, would this of happened???

i'll try to upload pics to another site first then lol, she pulled out of a private road, when i upload the pics you'll understand. i dont want to pass the blame, we know it was my wifes fault, im just trying to ease the pressure off from her abt, she only passed her test 2 months ago lol.

yay, it worked ... i think, right, she pulled out from where my coupe is and hit the blue bmw, the marks on our silver galaxy will polish out, but the marks on the bumper of the bmw wont. it is quite a tight turn, even i had to edge round in my coupe.

Looking at the pictures, I can't see how it can be anyone else's fault, the BMW looks to be legally parked.
As you've admitted, your wife has only been driving 2 months so this just looks like a case of inexperience unfortunately.
If its a company car then they are left with little choice but to get it repaired through the insurers.

not trying to blame anyone else, just trying to relieve the pressure from my other half, tbh, its obv her fault, and i got to pay her £600+ excess but as long as she's ok, thats all i care abt.

as i thought, even though i can get this sprayed up for less than half the excess. the highway code is a code, not a law, the 3rd party isnt "illegally" parked , just not parked to code 242 and code 243.5

sorry im a lorry driver and know the codes for things like that.

An accident is never someone's fault it he's standing still. Aywhere.it follows from the fact you should drive carefully and take into account tht anything might sit around the next corner, whether it is someone who has broken down, an accident, someone who fell while crossing the road,... or (unfortunatey?) someone who has just parked up behind a corner. Otherwise... you would virtually be allowed to just run into cars that sit in the wrong place and you'd be able to claim damage - pretty sure everybody would be looking for people parked in the wrong place and rubbing their already damaged cars against it to have the damage repaired by them.

Note - personally I would maybe find it a good idea to be allowed to run into badly parked cars so they'd stop parking there, but imagine the too narrow parking spaces where you can't but park on lines, the fact that you have to park max. 20cm from pavement, wheels should be straight, you should be parallel to the pavement,...etc. ad infinitum - and then that would be ust the start for discussions like "I wasn't parked but unloading" or "I wasn't parked rather I broke down - oh hey look at that she starts again, ithappens every time after a long run".

So I guess it's quite a logic 'law'.

ha ha haaa, er yea thats wot i thought .... pmsl. suppose her 1st car shouldnt have been a 2.3 galaxy then really, lol. an she wanted to take my coupe out rofpmsl, not a blooming chance. any ways, as i said to her, shit happens, she done the right thing in calling me as soon as it happened so i could spk to the people etc. she just got to deal with it lol.
