hope someone can help, will try and keep it brief. Bought a clutch off ebay and went ot have it fitted and it turns out the clutch release bearing was damaged so it couldnt be fitted. Rang the bloke who wasnt very helpful and said i need to send it back to him so he can send it to his supplier who will in turn send it back to valeo to have it assesed so i can get my money back, however i thought as i bought it from him i have a contract as such which means he has to refund me then take up the issue with his supplier or am i wrong!? Im down some money and i dont want to wait 4 weeks for this to be sorted, where do i stand?? Hope this is easy to understand and sorry to waffle on.

You are absolutely right. If he supplied you faulty goods, he must refund you immediately.
Did you pay by paypal? If so, open a dispute through them. They will see that you get a refund. If he refuses to pay, then they guarantee to pay anything up to £500 and chase him for the money/freeze his account until he has paid.
If you didn't buy through paypal, report him to ebay, which is also more than likely to get your refund sorted.

Adam
the thrust/release bearing arnt always that expensive
if you want it back on the road why dont you pop into L and R on sweet brier estate and see if they stock one
it may only be about £25
you can then try to get a part rebate from the guy you got the clutch kit from

stick with it Adam
he could come with a disclaimer saying the kit should have been checked before work took place
but he should still give you a total refund

You are absolutely right. If he supplied you faulty goods, he must refund you immediately. I sent a clutch off early in the year and only just got the report. I had a similar issue where i fitted a clutch and the release bearing was noisy. Played hell with the rep on the phone and actually got him to listen down the phone to the noise. They tried to fob me off with the first rattle saying it was oil contamination. Hard work getting a refund from the supplier, only managed it once in prob 10 claims down the years. Damage though is surely down to the delivery company though
