It is illegal to drive a car without a current MOT unless taking it to or from a prebooked MOT appointment. Therefore I would imagine the insurers could refuse to pay out any claim on the basis that the car does not comply with construction and use requirements.
Certainly they insist that the car be kept in a roadworthy condition.
